Terms and conditions of the FKP Scorpio Konzertproduktionen GmbH for the Rolling Stone Beach at the Ferien- und Freizeitpark Weissenhäuser Strand for festival tickets with accommodation

1. Scope and contractors

These terms and conditions are valid for the purchase of festival tickets including accommodation for the Rolling Stone Beach (in short: RSB) at the Ferien- und Freizeitpark Weissenhaeuser Strand. The festival tickets are composed of a concert part and an accommodation part. The contract is made with the FKP Scorpio Konzertproduktionen GmbH (also referred to as “promoter”). The Weissenhaeuser Strand GmbH & Co. KG or another (marketing) partner will not be a party to the contract (they may only take the orders for festival tickets in a messenger function for the FKP Scorpio Konzertproduktionen GmbH, and then pass the orders on to FKP Scorpio Konzertproduktionen GmbH). 3. Offer and conclusion of contract

Individual festival tickets are available while supplies last. The offers made concerning the Rolling Stone Beach located on the website www.rolling-stone-beach.de are non-binding, subject to change, and do not constitute offers in a legal sense. In addition, information provided verbally or given by telephone are non-binding. Relevant for the content of the contract concerning the festival tickets is the written booking confirmation by FKP Scorpio Konzertproduktionen GmbH, which will be sent by post or e-mail by Weissenhäuser Strand GmbH & Co. KG.

4. Tickets (admission authorization)

Only after the invoiced amount has been paid in full can the written or electronic booking confirmation authorize the ticket holder the valid admission to the concerts. In addition, the confirmation and a completely filled out key acknowledgment shall, upon receipt of the total invoice amount, also authorize the admission to the accommodation arrangements. The keys to the apartments as well as the right to admission shall be picked up at the front desk of the Weissenhaeuser Strand GmbH & Co. KG at the beginning of the festival.

5. Prices and terms of payment for the festival tickets

The currently at the festival website displayed festival ticket prices shown are valid per person and already include VAT. There is also a one-time booking fee of € 25.00 (incl. VAT) per apartment. For any additional bookings, e.g.VIP upgrades, or changes to existing bookings, a booking fee of € 19.00 (including VAT) will be charged.

The payment of festival tickets needs to be completed on account. The payment of the full ticket price is due within 14 days from receipt of invoice. If the booking is received within 20 days of when the festival begins, the total amount is due immediately. In this case, we recommend the use of the remittance slip attached to the order confirmation. If this slip is not available or for national online transfers, please transfer the amount due to the account of the Weissenhaeuser Strand Betriebs GmbH at the Volksbank: BIC (SWIFT-CODE) GENO DEF1NSH; IBAN: DE95 2139 0008 0000 515000. Please write your invoice number in the field specifying the reason for payment.

We also accept telephone bookings with MasterCard and Visa credit cards.

A cancellation of the concluded contract by the ticket holder (the contract was concluded by sending the booking confirmation by post or e-mail) is excluded. The statutory rights of withdrawal (e.g., failure to meet an obligation or impossibility) remain unaffected hereof.

If, after the written consent of the organizer, a cancellation is approved, then the following conditions apply: For cancellations of the contract up to 42 days before the start of the rental, in addition to the non-cancellable ticket fee amounting to € 129, - per person, a processing fee of € 20, - is due for cancellation of the apartment / hotel room. In case of a later cancellation up to 10 days before the start of the rental there will be 25% cancellation fee applied, after that a 50% cancellation fee of the apartment portion in the contract amount will be due. If the contracting party does not appear or departs early, the contracting party has no claim to any compensation for unused rental days.

The tenant is expressly allowed to prove that the landlord has not suffered any damages caused by the non-arrival or the cancellation or that the damage caused is less than the cancellation fee to be paid or the withheld rent.

6. Rented accommodation

The apartment, the bungalow or hotel room (object for rental) is provided for two nights from the beginning of the festival on a rental basis. On arrival you can claim the accommodation from 3 p.m. at the latest. Keys to the rented apartments will be handed out at the reception in exchange for a key receipt.

On the day of departure, the accommodation must be made available by 12:00 p.m. (an exception to this rule may be requested at the reception upon arrival or during the stay – departure may be moved to 2 p.m.) and the key needs to be returned to the reception. The rental property is rented with a full inventory in accordance with the inventory sheet and one set of linens. The inventory is to be treated with care. Damages caused during the rental period on the object of rental needs to be replaced by the tenant without proof of fault valued at price cost. The tenant is equally liable for damages that are caused by accompanying travelers. Orders for rented equipment will be accepted without obligation. 7. Object of rent

The ticket holder and / or tenant of the accommodation is / are bound to the regulations in force at the respective institutions of the Weissenhäuser Strand GmbH & Co. KG (house rules, parking regulations, swimming pool rules, etc.). By participating in the festival, the ticket-holder recognizes the rules set up by the establishments as binding. Misuse of rented objects like sub-letting, overcrowding, disturbance of privacy or peace etc., as well as non-payment of festival tickets or parts thereof, the contract may be terminated without notice.

8. Other

The landlord is not liable for loss or damage to any property of the tenant brought to the festival, including cars.

The guest bears the sole risk of liability for cash and valuables, left in the apartment or hotel room and cannot raise liability claims against the landlord regarding loss, destruction or damage of these.

No verbal subsidiary agreements exist.

Disturbances through exercises on the nearby “Truppenübungsplatz Putlos” or any (musical) performances within the framework of the (official) Festival program at the designated locations are possible.

During the festival, noise ordinance / nighttime peace is valid in all accommodations, hotel rooms and on public roads at the entire festival site between 01:00 a.m. and 08:00 a.m. Excluded from this are event locations that are in use within the (official) festival program. Possible night-time disturbances (for example by other festival guests) do not entitle visitors for partial refunds of the invoice sum.

The holiday and recreation park as well as the Strandhotel (seaside hotel) are smoke-free facilities. Smoking is permitted in designated smoking areas. Unauthorized smoking in the accommodation will be charged according to the corresponding cleaning costs.

The “Ferien- und Freizeitpark“ as well as the “Strandhotel” are smoke-free environments. Smoking is allowed in the designated smoking areas only.

9. Program Changes

Program changes can occur at festivals. In the event of the cancellation of individual artists (groups), the organizer shall endeavor to make appropriate substitutions. The visitor will not be entitled to a claim for the cancellation of individual artists (groups).

The maximum number of visitors allowed at specific event areas is limited for security reasons and will be enforced by the ordinance staff. It does not entitle the visitor to a partial refund of the invoice sum, if the temporary admission to individual event areas cannot be granted for security reasons.

11. Cancellation, Termination or Postponement of the event

11.1
An event can be cancelled or postponed. Please check our website in good time before the start of your trip to see whether the event will take place as planned.

11.2
Our liability in the event of cancellation, termination, postponement or other material changes to the event is limited to the refund of the nominal value of the ticket. Personal arrangements made by the ticket holder resp. guest, including travel in connection with the event, over and above the services contained in the ticket are made at their own expense and risk. In such cases, we are not liable beyond the refund of the nominal value of the ticket, in particular not for expenses incurred. For this limitation of liability, the limitations according to clause 21 apply accordingly.

A material change occurs when there is a change that makes the event a substantially different event than a ticket purchaser can reasonably expect. A change of one or more artist in the line-up of a festival does not constitute a substantial change in this sense.

11.3
If the event is cancelled, terminated or postponed due to circumstances for which the promoter is not responsible (e.g. force majeure such as restrictions due to the Covid 19 pandemic, especially in the event of mutations of the corona virus), the right of the ticket holder resp. guest to withdraw from the contract or otherwise demand its cancellation is excluded, subject to the following provisions. In the event of cancellation or termination, the promoter has the right to postpone the event at his own discretion.

If the event is postponed or - in case of cancellation or termination - made up for, the tickets for the event shall remain valid. However, the ticket holder resp. guest may demand reimbursement of the face value of the ticket in accordance with Clause 11.2 if he is unable to attend the postponed or rescheduled event for objective reasons. Glass bottles are not allowed in the Galeria. Filled drinking cups (official festival cups) are allowed at the Galeria and in every event location.

13. Prohibited items in the venues

For reasons of security and order as well as the avoidance of waste, a security check by the security service takes place at the entrance to the festival area. 14. Image and sound recordings

Only small-format cameras and mobile phones with a camera function are permitted on the event premises. SLR cameras, cameras with zoom lenses or any kind of video function are prohibited. Video cameras and audio recorders of all kinds, such as tape recorders, MP3 recorders and dictation machines, are also prohibited. The promoter may deny the visitor entry to the event site unless the visitor is willing to hand over the equipment at the entrance. There is no obligation on the promoter's part to store the objects.

15. Utilisation of sound and image recordings

The visitor consents irrevocably to the free use of his portrait and voice for photographs, live broadcasts, broadcasts and/or recordings of images and/or sound recordings made by the promoter, its agents or other third parties in connection with the event, and their subsequent exploitation in all current and future media (such as in particular in the form of audio and video carriers as well as the digital distribution, for example, via the Internet).

16. Exclusion of visitors

If there is an important reason, in particular if a visitor commits crimes (e.g. assault, theft, drug trafficking) or the setting of fireworks on the event site, the promoter is entitled to exclude the visitor from the event. If the promoter makes use of his right of exclusion, the ticket or festival wristband loses its validity. A claim for renewed admission or reimbursement of the purchase price is excluded.

17. Hearing and health problems

The promoter is only liable for hearing and other damage to health if he and his vicarious agents are guilty of intent or gross negligence or if a duty of care is culpably not fulfilled. Visitors should avoid placing themselves in direct proximity of the loudspeaker boxes; appropriate barriers must be observed. Remaining in the immediate vicinity of the loudspeaker boxes, or beyond barriers, is at the visitor's own risk. The use of earplugs is highly recommended, especially near the stages.

18. Children under the age of 6

From the age of 6 children need their own ticket. Children under the age of 6 are free. Children under the age of 6 are not allowed to be taken to the venues during musical performances. For example, the promoter may also exclude from the event guests who are found to have an elevated body temperature and/or guests who refuse to have their body temperature checked. 21. The liability of the promoter

The contractual and legal liability of the promoter for damages of any kind is excluded. This exclusion does not apply

  • for damages caused by the promoter intentionally or because of gross negligence;
  • in cases of (mild or simple) negligence of the promoter for damages due to injury to life, body or health; as
  • for the mild or simple negligent violation of essential contractual obligations by the promoter. Essential contractual obligations are those which must be fulfilled for the agreement to be properly executed, and the compliance with which the parties rely upon.

In cases of slight or simply negligent violation of essential contractual obligations, the liability of the promoter - except for damage to life, body or health - is limited to the contractually typical damage foreseeable for the promoter upon conclusion of the contract or commission of the breach of duty.

The promoter is only liable for hearing and other damage to health if he and his vicarious agents are guilty of intent or gross negligence or if a duty of care is culpably not fulfilled. Visitors should avoid placing themselves in direct proximity of the loudspeaker boxes; appropriate barriers must be observed. Remaining in the immediate vicinity of the loudspeaker boxes, or beyond barriers, is at the visitor's own risk. The use of earplugs is highly recommended, especially near the stages.

17. Children under the age of 6

From the age of 6 children need their own ticket. Children under the age of 6 are free. Children under the age of 6 are not allowed to be taken to the venues during musical performances. In addition, the participation of children and adolescents is determined by the parents and based on Youth Protection Act. According to the Civil Code (BGB), the parents have the duty and the right to care for the underage child (under 18 years). Incidentally, the statutory provisions of the German Youth Protection Act (JuSchG) apply in addition to all events.

18. Handling the ticket

The ticket is no longer transferable after its cancellation. A commercial resale of the ticket is not permitted. The tickets may not be privately sold at a price higher than the ticket price printed plus any proven fees charged upon purchase of the ticket.

Finally, the use of tickets for raffle purposes and / or for the implementation of sweepstakes is expressly prohibited. A breach of these conditions will result in the loss of the right to access without compensation, that is, the ticket will cease to be valid and the promoter is entitled to collect this ticket without refund of the entrance fee.

In case of loss of the entrance ticket or the festival wristband, for which the promoter is not responsible, there will be no replacement and no refund of the entrance fee.

19. Prevention measures

The promoter may also, in coordination with the competent authorities, order further appropriate preventive measures and prescribe rules of conduct, in particular to comply with health-related requirements (e.g. distance requirements, mouth and nose protection to prevent infection, etc.). For example, the promoter may also exclude from the event guests who are found to have an elevated body temperature and/or guests who refuse to have their body temperature checked. The guests have to follow these orders as well as the instructions of the security staff.

The promoter hereby gives notice that even full implementation of an appropriate protection and hygiene concept as well as compliance with all reasonable hygiene measures does not completely exclude the risk of an infection with the coronavirus disease (COVID-19) or other pathogenic organism for the visitor.

20. The liability of the promoter

The contractual and legal liability of the promoter for damages of any kind is excluded. This exclusion does not apply

  • for damages caused by the promoter intentionally or because of gross negligence;
  • in cases of (mild or simple) negligence of the promoter for damages due to injury to life, body or health; as
  • for the mild or simple negligent violation of essential contractual obligations by the promoter. Essential contractual obligations are those which must be fulfilled for the agreement to be properly executed, and the compliance with which the parties rely upon.

In cases of slight or simply negligent violation of essential contractual obligations, the liability of the promoter - except for damage to life, body or health - is limited to the contractually typical damage foreseeable for the promoter upon conclusion of the contract or commission of the breach of duty.

In that regard, the liability of the promoter for damages which are attributable exclusively to the risk area of the visitor is excluded. The above exclusions and limitations of liability also apply to the liability of the promoter for its organs, employees and vicarious agents as well as the personal liability of the Organs, employees and vicarious agents of the promoter.

21. Contractual relationship

The contractual relationship is governed by German law.
